What is the Fair Debt Collection Practices Act (FDCPA)?

The Fair Debt Collection Practices Act (FDCPA) is a federal law that was enacted in 1977 to protect consumers from unfair and abusive practices by debt collectors. The FDCPA applies to third-party debt collectors, not original creditors. It limits when and how debt collectors can contact a consumer about a debt and how they must treat the consumer. In Maryland, debt collectors must comply with the FDCPA as well as any applicable state laws. Under the FDCPA, debt collectors cannot contact you before 8 am or after 9 pm, or at inconvenient times or places such as your workplace. They also cannot harass, oppress, or abuse you in any way while attempting to collect a debt. This includes not using threats of violence or harm, using obscene or profane language, or making false statements to mislead or misrepresent the debt. Debt collectors are also required to provide certain information to consumers when they are contacting them about a debt. This includes the amount of the debt, the name of the creditor, and their right to dispute the debt or request more information. If the consumer disputes the debt, the collector must stop collection efforts and provide proof the debt is valid. Overall, the Fair Debt Collection Practices Act is an important law that provides consumers with basic rights and protections when dealing with debt collectors. It ensures that consumers are treated fairly and are not subjected to deceptive or abusive practices.
