The first step is to contact the Indiana Civil Rights Commission (ICRC) or the U.S. Department of Justice (DOJ). Both organizations have procedures in place to evaluate and investigate claims of civil rights violations. If a violation is found, the ICRC or DOJ can take action. This may include mediation, which is a process where the parties attempt to resolve the dispute through discussion. If mediation doesn’t work, then it may be necessary to file a civil lawsuit in court. When filing a civil lawsuit, a plaintiff must name the defendant (the person who allegedly violated civil rights) and allege the type of violation that occurred. The complaint must also set forth facts that support the claim. If the court is satisfied the claim has merit, it will issue a summons for the defendant to appear in court and answer the complaint.
