What are the rights of students with disabilities under IDEA?
The Individuals with Disabilities Education Act (IDEA) is a federal civil rights law that ensures students with disabilities in Indiana have certain rights in the areas of accommodations, special education services, and access to the general curriculum. Under IDEA, students with disabilities are entitled to receive an appropriate and individualized educational program tailored to the individual’s abilities, strengths, and needs. This program should be designed to meet the student’s individual needs and be offered in the least restrictive environment. IDEA also requires that systems be put in place to evaluate and identify students who may need special education and related services. School districts must have in place policies and procedures to ensure that children with disabilities are identified, located, and evaluated. Students with disabilities must be allowed to participate in state and district-wide assessments with appropriate accommodations. The school must also provide appropriate modifications to the general curriculum, as well as access to the same extra-curricular activities available to other students. The school must also provide appropriate behavior support, help them develop social and other necessary life skills, provide transportation, facilitate parent involvement, and respond to the needs of students with disabilities within a reasonable amount of time. Lastly, IDEA also requires that the school district provide for transition and post-graduation services to help students who have disabilities become independent and self-supporting adults.
