What civil rights do Native Americans have?

In California, Native Americans are granted civil rights that are protected under both federal and state law. Native Americans have the right to equal protection under the law, which includes the same rights to housing, education, and services afforded to all citizens of the United States. The Indian Civil Rights Act of 1968 (ICRA) provides the fundamental rights and privileges of Native Americans, including protections from discrimination, legal counsel for criminal prosecution, and freedom of religion. Under ICRA, Native Americans have the right to due process in criminal, civil, and administrative matters, as well as the right to present evidence and confront witnesses during legal proceedings. At the state level, California’s Native American Heritage Commission works to preserve, promote, and protect the rights, cultures, and ceremonies of Native American tribes. The California Indian Legal Services is a non-profit organization that offers legal advice and advocacy services to Native Americans, as well as educational programs and outreach to Native American communities. In addition, California’s Native American Heritage Act of 2018 provides additional protections for Native American religious, cultural, and burial sites. Through the protection of federal and state law, Native Americans in California are able to enjoy the same civil rights as all other citizens of the United States. These rights include equal protection under the law, due process, and the right to participate in and protect their own cultural traditions.
