Is it legal for a debt collector to claim they are going to take legal action against me?

In Florida, it is illegal for debt collectors to threaten legal action if they don’t intend to actually take any. It is a violation of the federal Fair Debt Collection Practices Act (FDCPA) to use false, deceptive or misleading practices when attempting to collect a debt. This includes making threats of legal action against someone without actually intending to take such action. Debt collectors are allowed to threaten a lawsuit as long as they actually intend to take legal action against the debtors. In most cases, the debtor has to already be in default for the creditor to consider filing a lawsuit. In any case, the debt collector is required to provide the debtor with more information about the debt, including the name of the creditor and how much the debtor owes. Under the FDCPA, it is also illegal for debt collectors to harass or abuse the debtors. This includes making threats of violence, using obscene or profane language, and contacting people repeatedly to annoy them or scare them. If you think a debt collector has violated your rights under the FDCPA or has illegally threatened you with legal action, you can file a complaint with the Federal Trade Commission. You can also file a lawsuit against the debt collector in order to recover any actual damages caused by their illegal activity.
