Can a debt collector contact me if I’ve offered to settle a debt?

In North Carolina, debt collectors can still contact you if you have offered to settle a debt. This is because a debt collector can still contact you to discuss settling the debt. When you make an offer to pay a debt, a debt collector may contact you to ask questions about your offer. The debt collector may also advise you of the consequences of not paying the debt in full. The Fair Debt Collection Practices Act (FDCPA) protects consumers from unfair or abusive debt collection practices. Therefore, debt collectors are also limited in how often they can contact you. They cannot continually call or send letters about the debt. If you ask the debt collector in writing to stop contacting you, they must do so unless they are filing a lawsuit over the debt. If a debt collector contacts you in violation of the FDCPA, you may have the right to file a complaint with the Federal Trade Commission. It is also important to talk to an attorney who specializes in debt collection laws, as they can help you understand your rights and legal options.
