What are my rights under the ADA?
The Americans with Disabilities Act (ADA) is a federal law that protects individuals with disabilities from discrimination in the workplace, public accommodations, education, and other areas of life. In New Hampshire, the ADA prohibits discrimination in employment and public accommodations. Under the ADA, an individual with a disability has the right to be free from discrimination in employment, including in the hiring process, job training, job assignments, promotions, wages and benefits, and job retention. Employers are required to provide reasonable accommodations to an employee with a disability as long as it does not create an undue hardship for the employer. In public accommodations such as hotels, restaurants, stores, and other types of businesses, the ADA requires that individuals with disabilities be provided access to services, programs, and activities. This may include providing accessible routes to buildings, providing interpreters for those with hearing impairments, and offering services such as wheelchair ramps to make it easier for people with disabilities to enter a business. The ADA also protects people with disabilities in educational settings. People with disabilities have the right to receive appropriate accommodations, such as interpreters and materials in accessible formats, so they can fully participate in educational activities. Schools are also required to make any necessary modifications to ensure that people with disabilities have access to the same opportunities and activities that everyone else does. In New Hampshire, everyone has the legal right to be free from discrimination on the basis of disability. If you feel that your rights under the ADA have been violated, you can file a complaint with the Department of Justice or contact an experienced disability rights attorney.
