What is the definition of disability under the ADA?
The Americans with Disabilities Act (ADA) is a federal civil rights law that prohibits discrimination on the basis of disability. The ADA defines disability as “a physical or mental impairment that substantially limits one or more major life activities”. This definition includes impairments that result from mental illnesses, learning disabilities, hearing impairments, vision impairments, speech impairments, physical disabilities, and neurological conditions. The ADA also includes conditions associated with aging, such as arthritis, and temporary impairments, such as broken bones or concussions. In South Carolina, the ADA is enforced by the State Attorney General’s Office. Through the Office of Special Investigations, they are responsible for ensuring that public and private entities comply with the ADA. This includes investigating complaints of discrimination, issuing warning letters to employers and other entities, and initiating legal action against employers that discriminate against individuals with disabilities.
