What is the reasonable accommodation process?

The reasonable accommodation process is the legal process by which persons with disabilities can obtain necessary accommodations or modifications in order to have equal access to facilities, programs, and activities. It is an important legal right afforded to individuals with disabilities under disability law in Texas. The process of obtaining a reasonable accommodation begins when an individual with a disability requests an accommodation from the party responsible for providing or administering the service or activity at issue. The request should include the type of accommodation sought and explain how the accommodation would help the individual access the service or activity. The party responsible for providing or administering the service or activity is then obligated to evaluate the request and, if appropriate, determine an accommodation that would be reasonable and provide it without discrimination. The party responsible for providing or administering the service or activity may deny the request for a reasonable accommodation if it can be demonstrated that providing the accommodation would impose an undue hardship or be ineffective in providing equal access to the service or activity. In the event of a denial, it is possible to appeal the decision. Once an accommodation is provided, it is important to ensure that it is effective in providing equal access. If the accommodated individual feels as though the accommodation is not effective in providing them with equal access, they can initiate a review of their accommodation. The reasonable accommodation process is a fundamental part of disability law in Texas and is an important tool for individuals with disabilities to obtain access to necessary services and activities.
