What are the legal requirements to qualify for disability benefits?
In Rhode Island, a person must meet certain legal requirements to qualify for disability benefits. First, a person must be found to have a disability according to the Social Security Administration’s definition. This means that the individual must have a physical or mental condition that prevents them from performing substantial gainful activity and the impairment is expected to last at least 12 months or result in death. Second, the qualifying individual must have a work history of at least five years in the ten years before their disability began, including at least 20 work credits earned in the last four years. In Rhode Island, for 2020, one credit is earned for each $1,410 earned, up to a total of four credits per year. Third, a person must be unable to work due to their disability, meaning that they must be unable to do the work they did before or any other substantial gainful activity. Finally, applicants will also need to provide medical documentation and other proof of their disability when filing a claim with the Social Security Administration. If an individual meets all these requirements, they may be eligible for Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI) benefits. However, the Social Security Administration must still review claims and may require applicants to attend a disability hearing.
