What type of discrimination is unlawful?
Discrimination in any form is unlawful in West Virginia. Discrimination occurs when an individual is treated differently or unfairly due to their race, color, religion, national origin, age, sex, ancestry, disability, or veteran status. According to Title VII of the Civil Rights Act of 1964, it is illegal to discriminate against any job applicant or employee on the basis of any of these categories. This means that employers cannot discriminate when it comes to recruiting, hiring, promotions, wages, job training, or any other terms and conditions of employment. The federal Age Discrimination in Employment Act and the West Virginia Human Rights Act also make it illegal to discriminate against workers who are 40 years old or older. It is illegal to discriminate against these workers with regard to job assignments, promotions, wages, layoffs, and termination of employment.
