What are the requirements for providing family or medical leave?

In the state of Kansas, employers must comply with the federal Family and Medical Leave Act (FMLA) when it comes to providing family or medical leave. This law requires that employers provide their eligible employees with up to 12 weeks of unpaid leave per year for certain qualifying events, including the birth or adoption of a child, the serious illness of an employee or direct family member, and certain military-related activities. In order to be eligible for family or medical leave under the FMLA, an employee must have worked for their employer for at least 12 months and have worked for at least 1,250 hours in the previous 12-month period. In addition, the employee must work for an employer with 50 or more employees within a 75-mile radius. At the federal level, employees are also guaranteed job protection while taking family or medical leave and are guaranteed to be returned to their same or equivalent position upon return from leave.
