What are the legal sources of human rights law?
In Virginia, there are several legal sources of human rights law. First and foremost is the United States Constitution. The Constitution provides many protections for individuals, including the right to due process of law, freedom of speech, the right to a jury trial, protection against cruel and unusual punishment, the right to be free from unreasonable searches and seizures, and more. These protections extend to all individuals within the United States, regardless of their race, gender, background, or other factors. In addition to the US Constitution, there are several state and local laws that provide individuals with human rights protections. This includes the Virginia Human Rights Act, which prohibits discrimination on the basis of race, color, religion, national origin, sex, pregnancy, childbirth or related medical conditions, age, marital status, disability, sexual orientation, gender identity, and status as a veteran. Other local laws may also provide protections in certain areas, such as the Virginia Fair Employment Act, which makes it illegal for employers to discriminate against employees on the basis of race, color, religion, sex, national origin, age, disability, or veteran status. Finally, there are international human rights laws that Virginia and other states must adhere to. This includes treaties and conventions signed by the US such as the International Covenant on Civil and Political Rights, which provides for the right to life, freedom from discrimination and torture, and the right to freedom of religion, speech, and assembly. Overall, Virginia recognizes a wide variety of sources for human rights law, including the US Constitution, state and local laws, and international treaties. These laws ensure that all individuals are granted the fundamental rights and protections that every human deserves.
