What is a no-fault claim?

A no-fault claim is a type of insurance claim that arises when an insured person is injured in an accident that is not their fault. Specifically in California, no-fault insurance claims are regulated by a statute known as the California Insurance Code. This code requires that all insurance companies provide compensation to their policyholders in the event of an uninsured accident. In a no-fault claim, the insurance company will provide compensation to the policyholder regardless of who was at fault for the accident. In most cases, the amount of compensation will be based on the severity of the injury and the costs incurred due to the accident. For example, a policyholder may receive compensation for medical bills, lost wages, and property damage. Additionally, a no-fault claim may cover additional expenses, such as costs for rehabilitation or lost earning capacity. When filing a no-fault claim, the insured individual is not required to prove that another person was at fault for the accident. Instead, the insurer must determine that the insured person was not at fault before approving the claim. Furthermore, the insurance company must also determine that the insured person was not negligent in causing the accident. No-fault insurance claims are intended to provide individuals with a faster, more efficient way to receive compensation for their injuries. These claims also help to reduce the amount of litigation that can often arise from personal injury cases.
