What is an “expedited removal”?

Expedited removal is a form of immigration enforcement used by the U.S. government to quickly remove certain immigrants from the country. Under an expedited removal process, an immigration officer can issue an order for an individual to be removed from the country without having to appear before a judge or other immigration authorities. In order for someone to be subject to an expedited removal, they must be apprehended at a port of entry (e.g. entering the U.S. from Mexico) or within 100 miles of the border, and the officer must determine that the individual is inadmissible to the United States. In Tennessee, expedited removal orders have been used to target individuals seeking asylum. This means that an individual can be quickly deported without appearing for their immigration hearing which would have allowed them to present evidence of why they are eligible for asylum in the U.S. In many cases, individuals facing expedited removal orders have limited or no access to legal counsel. This can make it difficult for the individual to present their case for asylum and can result in them being deported before they get the chance to do so.
