What is a “withholding only” application?

A “withholding only” application is a type of asylum claim that can be made in California and other parts of the United States. Individuals who fear returning to their home country because of the threat of persecution might be eligible for asylum. In such cases, a “withholding only” application may be made to the government to ask that they be allowed to remain in the U.S. without being removed. Under the Immigration and Nationality Act, the government has the ability to restrict the removal of certain individuals if it is found that they are likely to be persecuted in their home country, or that their life would be in danger if they were to be removed. The “withholding only” application is the mechanism through which such individuals may attempt to remain in the U.S. without the requirement of being granted asylum status. To make this request, the individual must be able to demonstrate that, if returned to their home country, they would more likely than not face persecution due to their race, religion, nationality, political opinion, or membership in a particular social group. The individual must also demonstrate that their life or freedom would be in danger because of the persecution. If the request is granted, the individual may remain in the U.S. and their removal is not authorized. However, this does not give the individual authorization to lawfully remain in the U.S., and does not offer them any other protections or benefits that come with asylum status. If seeking protection, individuals should contact an experienced immigration lawyer to better understand their options and to ensure that their rights are being fully protected.
