What is the “asylum clock”?

The “asylum clock” is a term used to describe the timeline for asylum seekers’ cases in California. In order to obtain asylum, individuals must work their way through the complicated legal process within a certain time limit. After an individual applies for asylum, they must wait to receive a Notice to Appear (NTA) in immigration court. This is the first step in the asylum process. Once the NTA is received, the individual must go to their immigration court hearing in order to explain their asylum claim. Depending on the outcome of the court hearing, the individual may be granted asylum, denied asylum, or their case may be continued to a later date. This is where the “asylum clock” comes in. The “asylum clock” refers to the timeline allowed for an individual to wait for their next hearing date. Once they receive their NTA, the clock begins ticking and the individual has 150 days to appear in court. If they fail to appear within this 150-day period, their asylum application may be denied. If the individual’s hearing is continued to a later date, the clock will reset and start counting down once again.
