What is the employer-sponsored immigration process?

The employer-sponsored immigration process is a way for businesses in Virginia to hire foreign workers in positions that cannot be filled by US citizens or permanent residents. Businesses can apply for an immigration petition with the US Citizenship and Immigration Services (USCIS) to hire a foreign worker. The employer must demonstrate that the foreign worker is qualified to do the job, and that no US citizens or permanent residents are available to do the job. The employer must also demonstrate that the job offer is for a permanent position, rather than a temporary one. After the USCIS reviews the application, they may issue an I-140 immigration petition to the business. The employer must then submit the petition to the Department of Labor, who will review the wage, working conditions, and labor certification of the job offer. If the Department of Labor certifies the petition, then the employer can continue the process by submitting an I-485 application to the USCIS. The foreign worker will also have to submit an I-485 application to the USCIS. The USCIS will then review the applications and interview the foreign worker and the employer. If the foreign worker meets all the requirements and passes the interview, they will be able to get their green card and work for the employer in Virginia.
