What is a Voluntary Departure?

Voluntary Departure is a type of departure for foreign nationals or immigrants who have violated their terms of entry or stay in the United States by remaining longer than the period authorized. In New York, the Department of Homeland Security agencies like U.S. Immigration and Customs Enforcement (ICE) can issue a Voluntary Departure (VD) order as an alternative to deportation. Choosing voluntary departure allows someone who is facing deportation to avoid the potentially more serious consequences that can come with being officially deported by the government. In a Voluntary Departure, the immigrant agrees to depart from the United States willingly by a set date and is then usually prohibited from applying for a visa or legal status for a certain period of time. If an immigrant fails to leave the country by the set date, VD can automatically become a removal order, and then the more serious consequences of deportation become applicable. Through Voluntary Departure, immigrants have the option of choosing to leave the U.S. on their own terms rather than facing deportation.
