What is an I-140 Immigrant Petition?
An I-140 Immigrant Petition is a form used in the U.S. immigration system to request permission for a foreign national to live and work in the United States permanently. The form, officially known as the Immigrant Petition for Alien Worker, is filed by employers who wish to sponsor a foreign worker for immigrant status in the U.S. In the U.S. state of Washington, the I-140 Immigrant Petition must be presented to the U.S. Citizenship and Immigration Services (USCIS) before the foreign worker can obtain their green card. This petition must be filed by an employer, who must demonstrate that the foreign worker is qualified for the position they are applying for, and that the employer is able to pay for the salary of the position. The I-140 Immigrant Petition requires evidence that the foreign worker meets the job requirements and has the necessary education and/or experience to perform the job. Additionally, the employer must prove that there will be no negative effect on the American labor market, by demonstrating that there are no capable American citizens capable of performing the job. Once an I-140 Immigrant Petition is approved, the foreign worker is eligible to obtain their green card and can continue to work in the United States, either permanently or temporarily. The petition process can take several months and may require multiple applications.
