What are the qualifications for an employment-based green card?
In Washington, to qualify for an employment-based green card, an individual must show that they have a job offer from an employer in the United States. The job offer must be in a specialty occupation, meaning it requires a college degree or specialized experience to perform the job. Additionally, the employer must obtain a labor certification from the U.S. Department of Labor (DOL). This document proves that no qualified U.S. workers were available for the job. In certain cases, employers must also file an Immigrant Petition for Alien Worker, Form I-140, with the U.S. Citizenship and Immigration Services (USCIS). Depending on the applicant’s immigration category, the employer or the applicant may be responsible for filing this petition.
