What are the requirements for an E-3 visa?

The E-3 visa is a type of visa that is only available to Australian citizens wanting to work in the United States. This visa allows the holder to enter the United States to work in a “specialty occupation”—a job that requires highly specialized knowledge and/or experience—for up to two years. The visa can also be renewed. In order to qualify for an E-3 visa, the applicant must first have a valid passport from Australia that is valid for at least six months beyond the intended stay in the United States. Additionally, the applicant must possess the necessary academic or other qualifying credentials that show their qualifications for the job which they will be performing in the United States. Employers in California who want to employ an E-3 visa holder must file a Labor Condition Application (LCA) with the Department of Labor, which certifies that the applicant is qualified for the job and will be paid at least the prevailing wage in the area. The employer must also meet certain labor condition requirements regarding wages and working conditions. The applicant will also need to demonstrate that the job is a specialty occupation and that they possess the necessary qualifications for the job. This could include a degree in the particular field or equivalent experience. The applicant must also describe the planned itinerary for their trip to the United States and prove that they will be able to support themselves financially while in the country. Once all of these requirements have been met, the applicant can then apply for the E-3 visa at the U.S. consulate in Australia. If approved, they will be able to travel to the United States to perform their job duties.
