What is the H-3 trainee visa?

The H-3 trainee visa is a work visa for those who wish to travel to the United States to receive training in their field. This visa is specifically designed for persons to receive training that is not available in their home country. The training can be in any field, including, but not limited to, education, commerce, communication, technology, health care, transportation, construction, agriculture, and the arts. The person must already have a job offer from a company in the United States and be sponsored by that company in order to receive the H-3 visa. The visa is valid for up to two years and at the end of that time, the trainee must return to their home country. The company that sponsors the trainee must agree to certain conditions, such as providing a structured training program, regular evaluation of the trainee’s progress, and paying the trainee’s wages. The trainee must also have the necessary qualifications for the training that they are receiving. In California, the H-3 trainee visa is regulated by the California Department of Fair Employment and Housing (DFEH). The DFEH has specific regulations that must be followed in order for the visa to be granted. For example, the training provided must be fair and equitable. The trainee must also be paid for their work and may not be paid less than the minimum wage. The trainee must also be offered worker’s compensation, health insurance, and other benefits as required by California law.
