What is the process for filing an application for adjustment of status?

When applying for adjustment of status in California, the process is similar to filing in other U.S. states. The first step is to file a Petition for Alien Relative, Form I-130. This form is used to determine if a foreign national has an eligible relative who is a U.S. citizen or a lawful permanent resident. This form is usually filed by their U.S. citizen sponsor. The second step is to file an Application to Register Permanent Residence or Adjust Status, Form I-485. This form is used to request permission to stay in the United States legally. It is also used to request permission to work and travel. Once the forms are filed, the applications must be sent to the U.S. Citizenship and Immigration Services (USCIS) for processing. USCIS will review the case and either approve or deny the application. If approved, USCIS will then issue the foreign national a Permanent Resident Card (Green Card). After the application is approved, the foreign national must complete an interview with USCIS. The interview is used to verify the information provided in the application. If the foreign national passes the interview, they will be granted permanent residency in the United States. In order to adjust their status to permanent residency, the foreign national must meet all of the requirements outlined by USCIS. This includes proving that they are admissible to the United States and meeting all other requirements. Once all of the requirements are met, the foreign national’s status will be adjusted to that of a permanent resident.
