What is the H-2B visa?

The H-2B visa is a type of non-immigrant visa available to employers in California who are looking to hire foreign-born workers to fill temporary or seasonal jobs. It is issued by the Department of Homeland Security (DHS) and allows foreign nationals to come to the United States to work in a “Specialty Occupation” or a job where there is a lack of qualified domestic labor. The main requirement of the H-2B visa is that the employer must prove that they cannot find enough eligible U.S. workers to fill the job and that the job requires special skills and knowledge that the foreign worker has. The foreign worker must also hold a valid passport and meet certain qualifications in order to be eligible for the visa. Once the H-2B visa is granted, the foreign worker is allowed to stay in the United States for up to one year to work in the job for which the visa was issued. They may also be allowed to bring their immediate family members as dependents under the H-2B visa. Overall, the H-2B visa is an important tool for employers in California who may have a hard time finding qualified domestic workers to fill temporary or seasonal jobs. While it allows foreign workers to gain legal work experience in the United States, employers must still adhere to strict regulations in order to qualify for the visa.
