What is labor certification?

Labor certification is a process that most employers in California must complete if they wish to hire a foreign worker. The process verifies that the employer has searched the U.S. labor market and found no qualified American worker to fill the open position. This means that the employer must prove that no one in the U.S. is available and suitable for the job, and that hiring a foreign worker would not adversely affect wages and working conditions of citizens already in the U.S. The employer must also demonstrate that they are able to pay the foreign worker a wage that is equal or higher than similarly situated American workers.
