What is labor certification?
Labor certification is a process that most employers in California must complete if they wish to hire a foreign worker. The process verifies that the employer has searched the U.S. labor market and found no qualified American worker to fill the open position. This means that the employer must prove that no one in the U.S. is available and suitable for the job, and that hiring a foreign worker would not adversely affect wages and working conditions of citizens already in the U.S. The employer must also demonstrate that they are able to pay the foreign worker a wage that is equal or higher than similarly situated American workers. Labor certification is a very complex process that must be completed to the satisfaction of the U.S. Department of Labor (DOL). Employers in California must first complete an online application, which includes details about the position and the applicant, as well as a detailed analysis of the labor market. After submitting the application, employers must wait for the DOL to make a determination on the case. If the DOL approves the application, the employer can submit the labor certification to the United States Citizenship and Immigration Services (USCIS). This will grant the foreign worker permission to work in the U.S. in the offered position.
