What is the H-2A visa?

The H-2A visa is a type of work visa that allows foreign nationals to work in the United States for a limited period of time, specifically for agricultural work. This type of visa is available to those who seek temporary or seasonal agricultural employment in California. The H-2A visa program was created by the Immigration and Nationality Act in 1986. This program helps employers in the agricultural industry find qualified workers who are not American citizens or legal permanent residents. The workers are hired to fulfill gaps in the agricultural labor demand in the United States and to ensure that the critical agricultural jobs are filled. In order to apply for an H-2A visa, employers must first submit a petition with supporting documents to U.S. Citizenship and Immigration Services, detailing the need for foreign agricultural labor and the number of workers that will be hired. The H-2A visa program is regulated by the U.S. Department of Labor and monitored by the California Employment Development Department (EDD). This program provides a legal way for temporary agricultural workers to enter the United States and get a job in California. This visa program helps to ensure a safe, legal and reliable source of agricultural labor for California. It offers protection for both the workers and the employers, ensuring that the workers receive fair wages and working conditions, and that the employers meet their labor needs.
