What is the PERM process?
The PERM process is a type of immigration law related to employment in California. It stands for Program Electronic Review Management and is a system used to review and certify labor certifications for foreign citizens who wish to work in the United States. This labor certification is needed for an individual to obtain an Employment Based Permanent Residence in the United States. The process begins with the filing of a labor certification request (LCA) with the Department of Labor, then the employer must complete and submit a PERM Form to the Department of Labor. This form contains all the necessary information needed to determine whether the job requirements as stated in the form fit the qualifications of the foreign national applying for the job. Once the PERM Form is received, the Department of Labor will review the application and determine whether the job requirements are consistent with the qualifications of the foreign national applicant. If the employer and applicant meet the criteria, the Department of Labor will certify the job requirements, granting labor certification for the applicant. The PERM process is an important step for foreign nationals to obtain legal employment in the United States.
