What is the process for applying for a reentry permit?

In California, the process for applying for a reentry permit is regulated by the U.S. Citizenship and Immigration Services (USCIS). To apply, individuals must submit an Application for a Reentry Permit, Form I-131. This form must be properly completed and signed, and any necessary supplemental documents must also be included. Applicants must provide evidence of their identity and legal immigration status in the U.S., such as a passport, valid visa, or other form of identification. Proof of current address, such as an utility bill or bank statement, must also be included. The application requires a filing fee, and if applicable, an additional biometrics fee for fingerprints. When submitting the application, individuals must provide evidence that they have a “well-founded fear of persecution” if they are to return to their home country. This evidence may include a statement from an immigration lawyer, letters from family members or friends, or other forms of documentation. If the application is approved, the USCIS will issue a reentry permit. The permit is valid for two years and must be presented at the port of entry upon departure and reentry into the U.S. It is important to note that the reentry permit does not guarantee admission back into the U.S. It is solely the decision of the Department of Homeland Security and the U.S. Customs and Border Patrol as to whether an individual is eligible for re-entry.
