What is a T visa?

A T visa is a type of nonimmigrant visa that allows victims of human trafficking, or modern-day slavery, to remain and work in the United States. T visas are available to individuals who have been victims of a severe form of human trafficking, and who are willing to cooperate with law enforcement in the investigation and/or prosecution of human trafficking perpetrators. In Massachusetts, a T visa applicant must first show proof of being the victim of a severe form of trafficking. An individual is considered a victim of severe human trafficking if they have been subjected to engaging in commercial sex acts, involuntary servitude, debt bondage, or slavery at the hands of a trafficking perpetrator. To be eligible for a T visa, the individual must also show that they are a citizen or national of a foreign country, or that they are an individual without nationality who has been continuously present in the United States since before January 1, 2002. Once an eligible individual has been identified, they can apply for a T visa. To do so, they must submit the appropriate forms with the U.S. Citizenship and Immigration Services (USCIS). Once the application is approved, the individual is granted a T visa and allowed to remain and work in the United States for up to four years. During this time, the individual can seek employment authorization and eventually apply for a green card.
