What is the process for applying for a spousal visa?
In Virginia, the process for applying for a spousal visa consists of several steps. The first step involves filing the appropriate paperwork with the U.S. Citizenship and Immigration Services (USCIS). This includes submitting an I-130 petition for an immediate relative or fiancé, along with supporting documents such as evidence of a legal marriage, evidence of finances, and other pertinent information. Once the paperwork is filed with USCIS, the petitioner will be assigned a priority date, and the petition will proceed through the process of adjudication. During this period, once the petitioner has received a notice of receipt and notice of action from USCIS, they can schedule an interview with the U.S. consulate to obtain an immigrant visa for their spouse. At the interview, the spouse will need to provide all their documents, including a birth certificate, passport, and evidence of a legal marriage. If the interview is successful, the spouse will be issued a visa. After the visa is issued, the spouse will need to travel to the United States within six months and present the visa to a U.S. Customs and Border Protection officer at the port of entry. Once they have entered the country, the spouse will receive an I-551 stamp or card, known as a “green card”, which allows them to live and work in the US. These are the steps for applying for a spousal visa in Virginia. The process can be complicated, and it’s important that the petitioner seek the help of a qualified immigration attorney to ensure the process goes as smoothly as possible.
