The process for filing an application for an E visa in North Carolina is relatively straightforward. To be eligible, you must first meet at least one of the criteria for one of the four “E” categories – E-1, E-2, E-3 and E-4 - based on a treaty of trade or navigation between the United States and the foreign country of which the applicant is a citizen or national. Once you have determined that you meet the criteria for one of these four categories, you will need to file Form I-129 with the U.S. Citizenship and Immigration Services (USCIS). Along with the form, you will need to provide evidence that you meet the criteria for the E visa, such as a copy of the treaty, evidence of your ability to invest in a business or proof of employment as a treaty worker. If the USCIS approves your application, they will issue you an I-797 Approval Notice that will allow you to travel to the United States. Upon arrival in the United States, you will need to proceed to a designated port of entry and present the I-797 and other documents to the Customs and Border Protection Officer. The officer will then review the documentation and decide whether to authorize your admission. Once you have been admitted to the United States, the USCIS will issue you an Employment Authorization Document (EAD) that will allow you to work in the United States for the duration of your visa. You will need to renew your EAD every two years and pay the appropriate fees, or else you risk having your E visa revoked.
