What are the different types of labor disputes?
Labor disputes are disagreements between employers and employees about labor laws, wages, working conditions, and other related issues. In South Carolina, labor disputes are regulated by the state’s industrial relations law. The most common type of labor dispute is a collective bargaining dispute, in which an employer and a group of their employees, represented by a labor union, try to reach a mutually beneficial agreement about wages, working conditions, and benefits. This occurs when an employer and employee disagree about a provision in a labor contract or an individual employment agreement. This is a dispute between an employer and an employee about whether the employee was wrongfully discharged from their job. In South Carolina, wrongful termination disputes are adjudicated by the state’s Department of Employment & Training. Finally, a fourth type of labor dispute is a discrimination dispute, in which an employee believes they were discriminated against by an employer due to race, gender, age, religion, or other protected class. In South Carolina, discrimination disputes are regulated by the state’s Human Affairs Commission.
