What is the International Law Commission?

The International Law Commission (ILC) is an organization created by the United Nations that promotes the development of international law. Established in 1947, the commission is made up of 34 eminent international lawyers from all over the world, including North Carolina. The ILC’s primary purpose is to promote and codify international law, and its efforts are often aimed at smoothing out the differences among international legal systems. The ILC’s work is organized into four distinct stages. First, the commission studies existing international law and current international practice in order to identify possible areas of improvement. Second, the ILC drafts “draft articles” and “draft commentaries” based on their collected data. Third, the commission reviews and circulates the drafts to other United Nations organs and other countries for feedback. Finally, after gathering comments and suggestions, the ILC presents final drafts to the United Nations General Assembly for it to consider adoption. The ILC’s work is often critical in ensuring the smooth functioning of the international legal system and to ensure that international law remains uniformly applicable across different countries. The commission’s efforts have helped to create systems of international legal protection and dispute resolution, as well as the establishment of international laws protecting human rights and fundamental freedoms.
