What is the International Law of Humanitarian Intervention?

International Law of Humanitarian Intervention is a set of principles and standards set out by the United Nations (UN) that governs how countries should go about intervening in another country’s affairs to protect the human rights of its citizens. It is based on the idea that all countries have a duty to protect citizens from violations of their human rights and to prevent such violations from occurring in the future. This means that when a country’s citizens are suffering from gross human rights abuses, that country may be subject to military intervention by other nations in order to rescue the citizens from their oppressors. Under international law, humanitarian intervention is only lawfully permissible under very specific conditions. Generally, the UN must first determine if a situation is in violation of human rights, and if a situation meets this criteria, the UN may authorize a military intervention on behalf of the suffering people. Additionally, the UN must determine that the intervention is a last resort after all peaceful measures have failed; any intervention must be limited in its scope and aim to restore the peoples’ human rights without the use of excessive force. International Law of Humanitarian Intervention is an important tool that can be used to protect the human rights of citizens in countries throughout the world, including those in California. As a part of the global community, California has a responsibility to support the UN’s efforts to protect human rights. Thus, lawmakers in California should be aware of and stand with the UN in its efforts to promote and protect human rights around the world.
