What is the International Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (CAT)?
The International Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (CAT) is an international human rights treaty that protects persons from all forms of torture, cruel, inhuman, and degrading treatment or punishment. The treaty was adopted in 1984 and came into force in 1987. CAT prohibits torture and other cruel, inhuman, and degrading treatment or punishment in any form. It also requires that any person under the jurisdiction of a state party is entitled to certain rights in order for them to be protected from torture and other forms of ill-treatment. These include the right to humane treatment, the right to have access to medical and psychological services, the right to be kept informed of one’s rights, and the right to be heard in court. CAT has also been incorporated into California law through the Ratification Act of 1988. This act prohibits any public official, employee, or other person acting in an official capacity from participating, allowing, or condoning any form of torture or other cruel, inhuman or degrading treatment or punishment. California therefore is obligated to comply with CAT and protect individuals from torture and other forms of ill-treatment.
