What is the International Convention for the Protection of All Persons from Enforced Disappearance (CPED)?
The International Convention for the Protection of All Persons from Enforced Disappearance (CPED) is an international treaty that seeks to protect individuals from the enforced disappearance of persons by state actors. It was adopted by the United Nations General Assembly in December 2006 and entered into force in December 2010. The CPED applies to all states that are party to it and protects all individuals from enforced disappearance regardless of their nationality, place of residence, gender, race, color, language, religion or belief, political or other opinion, national or ethnic origin, property, birth or other status. In California, the Convention applies to all persons within the jurisdiction of the State, regardless of the persons’ nationality or place of residence. All persons in California must be protected under the Convention from any form of enforced disappearance. This includes the right to life, liberty and security, the right not to be subjected to torture and other cruel and inhuman treatment or punishment, the right not to be subjected to enforced disappearance, as well as the right to recognition before the law. The Convention requires States to search for the persons who have been disappeared and, if found, to ensure that they are not subjected to a similar fate in the future. The Convention also requires states to take legal action against anyone responsible for an enforced disappearance, and to provide compensation to the victims. All victims of enforced disappearance also have the right to truth and justice.
