What is the International Convention for the Protection of All Persons from Enforced Disappearance (CPED)?

The International Convention for the Protection of All Persons from Enforced Disappearance (CPED) is an international human rights treaty adopted by the United Nations General Assembly in 2006. The CPED defines enforced disappearance as “the arrest, detention, abduction or any other form of deprivation of liberty by agents of the State or by persons or groups of persons acting with the authorization, support or acquiescence of the State, followed by a refusal to acknowledge the deprivation of liberty or by concealment of the fate or whereabouts of the disappeared person, which places such a person outside the protection of the law.” The CPED serves to protect people from the crime of enforced disappearance, such as kidnappings, abductions, and secret detentions. The treaty requires that signatory states take steps to prevent enforced disappearance and to create laws to punish those responsible. It also requires signatory states to take steps to ensure that relatives of the disappeared receive information about the fate of their loved ones. The CPED has been signed by 116 states, including Washington, but has not yet entered into force as only 25 nations have ratified the treaty. In 2020, Washington signed the treaty and sent it to the Senate for ratification. This is an important step towards ensuring the protection of human rights for individuals in Washington and those around the world.
