What is the notice of infringement under the DMCA?

The notice of infringement under the Digital Millennium Copyright Act (DMCA) is a notification sent to an Internet Service Provider (ISP) or online service provider when there is a suspected copyright infringement occurring on their network. This includes things like illegal downloads of copyrighted materials such as music, movies, and software. It is the duty of the ISP or online service provider to investigate all claims of infringement and take the necessary steps to immediately remove or disable access to the material in question. The notice of infringement must include a physical or electronic signature of a person authorized to act on behalf of the copyright owner. The signature must include the title and address of the copyright owner or their agent, a description of the work that has been infringed, the specific URL or IP address where the copyright infringement is occurring, a statement from the copyright owner that they have a good faith belief that the material is unauthorized, and a list of contact information for the copyright owner or their agent. In Mississippi, ISP’s and online service providers who receive a notification of infringement must confirm the validity of the notice and take appropriate action, such as disabling or removing the allegedly infringing content, within fourteen days. Failure to do so can lead to potential liability for the ISP or online service provider.
