What is the Lilly Ledbetter Fair Pay Act?
The Lilly Ledbetter Fair Pay Act is a labor law that was passed by Congress in 2009 that expands a worker’s right to challenge wage discrimination in the workplace. This Act is named after Lilly Ledbetter, an Alabama woman who filed a lawsuit against her employer because she discovered that she was being paid significantly less than her male counterparts who were doing similar jobs. The Act allows employees in Arizona and across the country to challenge unequal wages that are based on gender, race, religion, age, and other protected traits. The Lilly Ledbetter Fair Pay Act amends the Civil Rights Act of 1964, which prohibits discrimination in employment. It ensures that workers are able to challenge their employers for wage disparities and that the statute of limitations for filing a claim is not permanently suffered after an initial paycheck is received. Employers are now required to provide equal pay for equal work regardless of gender, race, religion, age, and other protected traits. The Act also prohibits employers from retaliating against workers who raise concerns about wage disparities in the workplace. This means if an employee has a reasonable belief that they are being discriminated against based on their protected trait, they can file a complaint with the Equal Employment Opportunity Commission or take legal action against their employer without fear of retaliation. Overall, the Lilly Ledbetter Fair Pay Act provides Arizona employees with an important tool to fight discrimination in the workplace and ensures that workers of all backgrounds receive equal pay for equal work.
