What are the laws governing child labor?

Child labor laws in California are governed by both state and federal law. At the state level, no minors under the age of 18 can be employed in any hazardous occupation. They also cannot work more than 8 hours a day or more than 48 hours a week. The state also sets restrictions on the types of jobs minors can hold such as mining, sawmilling, service in a liquor store or tavern, and specific occupations related to construction and manufacturing. At the federal level, the Fair Labor Standards Act (FLSA) sets guidelines for employment of minors. According to the FLSA, no child under the age of 16 may be employed without a special permit from the Department of Labor. The FLSA also sets restrictions on the hours minors can work. Minors under the age of 16 are prohibited from working more than 3 hours a day during school weeks, 8 hours a day on non-school days, and 40 hours a week. In addition to the restrictions put in place by the state and federal laws, employers must also abide by any additional rules and regulations set by their local governments. It is important for employers to check with their local government to make sure that they are adhering to all applicable laws and regulations on employment of minors.
