How do I recognize a union?
In South Carolina, a union is recognized once it has been certified by the National Labor Relations Board, or NLRB. It is the responsibility of the NLRB to certify unions after an employee or group of employees have submitted a petition for union recognition. The NLRB may also recognize a union if it has been voluntarily recognized by an employer. In order to be recognized by the NLRB, an employee or group of employees must submit a petition. The petition must include signatures from a majority of the employees involved, as well as the names of the union officials. Once the petition has been submitted, the NLRB will hold a hearing to determine whether or not the union should be certified. If the NLRB determines that the union has a majority of support among the employees, it will certify the union. If an employer voluntarily recognizes a union, the NLRB must still hold an election in order to determine if the union has the majority support of the employees involved. If the employees in the election vote in favor of the union, the NLRB will certify the union. Once the union is certified, the NLRB will oversee the negotiations between the employer and the union. It is also responsible for ensuring that both parties are following the relevant labor laws. Unions also have the right to bargain for wages, benefits, and other employment terms and conditions.
