What are the rules governing wages and overtime?
In South Carolina, labor relations laws cover wage and overtime rules. Generally, all employees must be paid at least the minimum wage, which is currently $7.25 per hour. Additionally, employers must pay any overtime wages of at least 1.5 times the regular pay rate for any hours worked over 40 hours in a work week. Some employees are exempt from the wage and overtime requirements, such as executives and outside sales personnel, as well as independent contractors. However, some employees who are classified as exempt may still be entitled to overtime wages if the job duties do not meet the requirements for exempt status. South Carolina also has laws related to tips earned in the workplace. Employers must provide employees with wages that equal at least the minimum wage, even if the employee is paid in tips. Additionally, employers cannot require employees to pool or split their tips with other employees or customers. Finally, employers must provide employees with an itemized list of all wages paid at the time of pay, as well as any deductions. Employers must also keep accurate records of employee pay, hours, and deductions so that accurate wage statements can be provided.
