What are the rules governing wages and overtime?

In Virginia, employers must adhere to the state and federal laws on wages and overtime. According to the Virginia Department of Labor and Industry, state law requires that employers pay all employees the minimum wage, which is currently $7.25 per hour. Employers must also pay overtime if an employee works more than 40 hours in a single workweek. The overtime rate is 1.5 times the employee’s regular pay rate. Employers must keep accurate records of all hours worked and any overtime. Employees must also be paid in full at least twice a month. It is also important to note that employers cannot require employees to work off the clock without pay, and they cannot require employees to work overtime without pay. If an employee protests poor working conditions, they cannot be fired or retaliated against. Employers must also comply with all relevant safety requirements. Finally, Virginia employers are prohibited from discriminating against employees based on race, color, religion, sex, national origin, age, or disability. Employers must also be sure to follow all other applicable laws, such as the Family and Medical Leave Act and the Fair Labor Standards Act, when determining wages and overtime.
