How do I file a grievance?
Filing a grievance in Washington State is not a complicated process, but it requires that certain steps are taken. Generally, a grievance must be filed in writing, either by hand delivery or mail, to the labor relations office that is assigned to handle the complaint. The document must specify the nature of the grievance, the outcome desired and any other relevant information. The labor relations office then reviews the grievance as well as any supporting evidence provided by the party filing the grievance. The person filing the grievance may also be asked to meet with the labor relations officer in person to discuss the grievance and any possible solutions. The office then makes a determination of whether or not the lawsuit is justified. If it is, the office may attempt to settle the grievance through mediation or arbitration. If the matter cannot be settled through those methods, the grievance is taken to a formal hearing. At the hearing, the labor relations officer or a referee appointed by the government hears both sides of the case and makes a decision based on the evidence presented. This decision is then either accepted or contested by the parties involved. If the decision is contested, the matter goes to court for a final ruling. No matter what the outcome of the grievance process, it is always important to remember that you have rights as a worker in Washington State.
