What is the Uniform Code of Military Justice (UCMJ) Article 99?

Article 99 of the Uniform Code of Military Justice (UCMJ) is the catch-all provision related to the offenses not specifically covered in the other articles of the UCMJ. This article is considered a “general article,” meaning it serves as the overarching rule for all other offenses not outlined in the specific articles. Article 99 makes it a crime for a member of the military to disobey the lawful order of their superior, or willfully fail to obey any regulation, or disobey any order or instruction from a superior, or who otherwise knowingly impede justice or good order. The regulations of Article 99 can vary from state to state. In most states, it is treated as a misdemeanor offense and offenses can range from disobeying orders on a military base, to being absent without leave (AWOL). In Tennessee, Article 99 is considered a felony offense and carries much harsher punishments that can include a dishonorable discharge and jail time. Additionally, Article 99 can be used to prosecute military members who are accused of engaging in activities that are considered detrimental to good order and discipline within the military, as well as activities that are illegal under the UCMJ.
