What is a maritime lien?

A maritime lien is a claim against a vessel that arises from the vessel’s use of services related to maritime commerce. In the state of Florida, these services can include repairs to the vessel, medical care for the vessel’s crew, the provision of supplies, or the carriage of goods. A maritime lien is a special type of lien because it does not require a contractual duty between the vessel and the service provider. Instead, the lien is created simply because the vessel has used or benefits from the services related to maritime commerce. The maritime lien gives the service provider certain rights. Notably, the service provider can take legal action to seize the vessel until the money owed is paid. Further, the lien has priority over other claims as it is enforced directly against the vessel itself. It is also important to note that maritime liens are not subject to the general rules of security interest, meaning that they are not affected by any changes in the vessel’s ownership. In Florida, the law regarding maritime liens is governed by the Uniform Commercial Code. The UCC states that vessel owners must pay for services related to maritime commerce before any other debts can be discharged. Further, the UCC requires that the lien remain in effect regardless of any change in the vessel’s ownership. Finally, the UCC also outlines the procedures for the filing and enforcement a maritime lien.
