What is the Native American Graves Protection and Repatriation Act?

The Native American Graves Protection and Repatriation Act (NAGPRA) is a federal law that was passed in 1990 to protect Native American graves, funerary objects, sacred objects, and objects of cultural patrimony. The law was designed to protect the rights of Native American tribes to repatriate funerary objects and other items of sacred importance. Under NAGPRA, tribal governments are responsible for the repatriation of Native American remains, funerary objects, sacred objects, and cultural patrimony. All public institutions and agencies that receive federal funding, such as universities and museums, are required to inventory and identify Native American objects in their possession and return them to the appropriate tribes. The law also provides for the repatriation of human remains, associated funerary objects, and other items of cultural patrimony that have been discovered on federal or tribal lands. In Washington, NAGPRA established the Governor’s Native American Heritage Advisory Council in 1996. This council is composed of members of tribal governments and other stakeholders and is responsible for implementing NAGPRA in the state. The council also works to promote the protection and preservation of Native American culture, history, and objects of historic and cultural importance. NAGPRA is an important act that provides a mechanism for the repatriation of Native American remains and objects of cultural and religious significance. It also plays an important role in protecting and preserving the rights of Native American tribes and cultures.
