What happens after I report nursing home abuse?

After you report nursing home abuse, the Washington State Department of Social and Health Services (DSHS) Adult Protective Services (APS) will investigate the situation and contact the person responsible for the care of the elder. They will also contact the provider, who must cooperate with the investigation. APS will take appropriate measures to ensure the safety and well-being of the elder, including prohibiting an abuser from returning to the facility. If criminal activity is suspected, law enforcement may become involved. The investigation will involve interviewing and gathering evidence of the abuse. An APS social worker will talk to the elder and anyone else with knowledge of the incident. They may ask the elder and the perpetrator to sign a conflict resolution agreement and offer support and services to the elder. The perpetrator may also be prevented from visiting the facility. The DSHS will follow up and take further action based on the results of the investigation. APS may contact the local long-term care ombudsman to ensure the elder is getting the care they need if the nursing home is not meeting their needs. The DSHS may also refer a case to a Protective Services Worker in Washington who will take civil action on behalf of the elder to seek damages, restitution, and other remedies. The perpetrator may be held accountable for their actions and face criminal penalties. All reports of nursing home abuse in Washington are taken seriously and you can be assured that your report will be investigated.
