Is it possible to patent software?
Yes, it is possible to patent software in Washington. A software patent is a form of intellectual property protection granted by the federal government which gives an inventor exclusive rights to market and license their invention. The requirements for a software patent are essentially the same as any other type of patent, except the invention must involve a system, process, method, or computer-readable medium that is new and not obvious to someone who is knowledgeable and experienced in the same field. In order to qualify for a software patent, the invention must fulfill four criteria: novelty, usefulness, non-obviousness and an enabling description. The invention must be something new or innovative that has not been previously created or used. The invention must also provide some level of usefulness or utility, and it must not be obvious to someone who is familiar with the same field. Lastly, the patent application must include an enabling description that provides detailed information about the invention and how to make and use it. If a software invention qualifies for a patent, the inventor will be granted a set of exclusive rights which allow them to control the production, use, sale and distribution of their invention. These exclusive rights will remain in effect for a period of 20 years from the date that the patent is granted. After the 20-year period is over, the invention will become part of the public domain and anyone can legally use the invention without the inventor’s permission.
